Horry County Treasurer Clarifies License Status Ahead of Ward's Zoning Hearing

Ahead of an upcoming rezoning hearing, Horry County Treasurer Angie Jones clarified that the ongoing zoning dispute surrounding Ward’s Soft Serve and Ward’s Boat Storage will not automatically result in the loss of the business’s license. Jones emphasized that license revocation requires a rigorous legal process and is not a direct consequence of a zoning debate.

Under South Carolina law and municipal codes, suspending or revoking a business license involves formal procedures, clear written notice, and an opportunity for a hearing. State guidelines stipulate that local license programs must protect business owners' due process rights. While municipalities hold the authority to close businesses that present immediate public health or safety threats, standard zoning disagreements do not meet that threshold.

Jones noted that her office focuses on helping businesses operate safely rather than revoking permits over administrative debates. Additionally, businesses selling prepared items like soft serve generate hospitality fee revenues, which support local infrastructure and tourism projects across Horry County, unlike sales of pre-packaged goods.

The underlying zoning request remains subject to official review. The Horry County Planning Commission is scheduled to evaluate the RE4 rezoning request on Thursday, September 3, 2026, at 5:30 p.m. at the Horry County Council Chambers. Opponents, including the Greater Burgess Community Association, continue to challenge the request.

While the outcome of the rezoning request will determine how the property is used, local officials confirm that the business license itself remains secure absent a formal public safety issue.
